Dandy Porch Club — Terms and Conditions
Fall 2026 Collection
Effective September 8, 2026 • Last Updated September 8, 2026
These Terms and Conditions ("Terms") govern your use of dandyporch.com and your purchase of seasonal planter services from Dandy Porch Club ("Dandy," "we," "us," or "our"). Please read these Terms before placing an order. By placing an order and completing checkout, you agree to be bound by them. These Terms include an authorization allowing Dandy to photograph installations and use non-identifying photographs as described in Section 20. If you do not agree to these Terms, please do not place an order.

1. About Dandy
Dandy designs, supplies, and installs seasonal live-plant arrangements in customers' existing outdoor planter containers. Our current service area includes eligible residential and business addresses in Franklin and Brentwood, Tennessee. Unless an order expressly says otherwise, Dandy provides the plants, growing media, design, planting, installation, and ordinary cleanup associated with a seasonal planter refresh. Dandy does not sell or provide the customer's planter containers as part of the Fall 2026 service.
2. Eligibility and Service Area
Service is available only at addresses Dandy accepts within its current service area. When you enter your service address, our website may determine that the property is eligible for service; outside our current service area; or subject to additional review. If your address requires review, Dandy may contact you for additional information before accepting an order.
Our service area may change from season to season. Prior service does not guarantee that an address will remain eligible in a future season. We may decline an order when we reasonably determine that we cannot safely, practically, or reliably provide the requested service.
3. Your Seasonal Planter Service
Unless otherwise stated in your order confirmation, a seasonal planter service includes: a planting plan developed for the applicable container, season, light conditions, and preferences you provide; seasonal plants and growing media; removal and disposal of the existing seasonal plant material ordinarily contained in the planter; planting and installation; ordinary cleanup of the immediate work area; and a simple Care Guide.
Our arrangements are planted by Dandy or by trained planting partners working on Dandy's behalf. Dandy remains responsible to you for the services purchased from Dandy even when a planting partner performs some or all of the physical installation.
4. Your Planter Containers
Dandy's seasonal planter service is designed for planter containers that you already own. You represent that you are the owner of the container or otherwise have authority to authorize Dandy to work on it.
Minimum size. Unless Dandy expressly approves otherwise, we do not service containers with an inside opening smaller than 12 inches.
Measurements. Pricing and planting plans may be based on measurements and other information you provide, including the inside opening and usable planting depth of each container. You are responsible for providing reasonably accurate measurements. If the actual size or condition of a container differs materially from the information submitted with your order, Dandy may pause work and contact you before proceeding. We will not knowingly install an arrangement that materially exceeds the scope or price of your accepted order without your approval.
Container condition. Your container must be reasonably structurally sound, stable, accessible, capable of holding the intended planting media, capable of adequate drainage, and safe for Dandy personnel to work on or around. Dandy may decline to plant a container that is cracked, unstable, deteriorated, improperly supported, unsafe, or otherwise unsuitable for installation. If Dandy determines at the installation that a container cannot reasonably be serviced, we will refund the amount paid for that affected container. Charges attributable to other containers successfully serviced as part of the same order will not be refunded solely because one container was rejected.
5. Customer Information and Site Conditions
You agree to provide information that is reasonably accurate and complete, including your service address; container measurements; container quantity; light conditions; access instructions; planting preferences; photographs you elect to provide; and information about gates, pets, alarm systems, irrigation, or other site conditions that may affect our work.
Dandy may rely on the information you submit when preparing your planting plan and price. You should notify us before installation if information you previously supplied becomes inaccurate.
6. Prices
The price shown for each planter is based on the information provided during the ordering process, including container size and selected services. Your order may also include an applicable Service & Delivery charge. The standard Service & Delivery charge is $39 per order and is waived when the applicable order subtotal is $500 or more, unless a different amount is clearly disclosed before checkout.
The prices displayed before checkout are exclusive of applicable sales tax unless expressly stated otherwise. Dandy may change prices for future orders at any time. A price change will not affect an order that has already been accepted and paid.
7. Sales Tax
Applicable Tennessee state and local sales tax will be calculated and collected at checkout based on the transaction and service location. For taxable Dandy seasonal planter transactions, tax may apply to the entire taxable sales price, including associated planting and installation charges. The amount of tax shown at checkout controls for the particular order. Changes in tax rates or tax law may affect future orders.
8. Payment
Payment is due when you complete checkout unless Dandy expressly agrees otherwise in writing. Payments are processed through Shopify and its payment-processing providers. Dandy does not directly receive or store your complete payment-card information.
Your order is not confirmed until payment has been successfully completed and Dandy issues an order confirmation. A saved plan, estimate, abandoned checkout, or draft order does not by itself reserve inventory or an installation date. If a payment is reversed, declined, disputed, or otherwise not successfully completed, Dandy may suspend or cancel the affected order.
9. Scheduling
Installation timing may depend on season, plant availability, route scheduling, weather, and order volume. For the Fall 2026 season, installations are anticipated to begin on or about October 7, 2026. Any date advertised before an order is scheduled is an estimate unless Dandy expressly identifies it as a guaranteed date. After ordering, Dandy will provide or confirm an installation date or installation window. You do not ordinarily need to be home during installation.
10. Property Access
You are responsible for providing reasonable access to the containers at the scheduled installation time. Containers should be accessible from the street, driveway, walkway, porch, or an unlocked gate unless other arrangements have been made with Dandy.
Before installation, you should tell us about circumstances that may affect access or safety, including locked gates, gate codes, animals, alarm systems, restricted areas, construction activity, irrigation equipment, or other unusual property conditions.
If Dandy cannot access the property or containers at the scheduled time because reasonable access was not provided, we will contact you. The first rescheduling caused by inaccessible containers will ordinarily be made without an additional return-visit charge. If Dandy makes an additional trip because the property or containers remain inaccessible, Dandy may charge a reasonable return-visit fee. We will disclose that fee and obtain your agreement before scheduling the additional visit.
11. Plants and Substitutions
Plants are agricultural and living products whose availability, size, color, growth habit, and appearance may vary. Photographs, illustrations, examples, and prototype arrangements on the Dandy website represent design direction and are not promises that your arrangement will contain identical plant varieties or appear exactly the same.
Dandy may substitute a plant or botanical material when reasonably necessary because of availability, condition, quality, seasonality, or horticultural suitability. Any substitution will be selected with the goal of maintaining substantially similar design character, scale, color relationship, seasonal suitability, light suitability, and overall quality. A reasonable plant substitution does not constitute a defective or incomplete installation.
12. Living Plant Conditions
Plants are living things. Their condition after installation is affected by circumstances that Dandy does not completely control, including watering, drainage, sunlight, temperature, wind, storms, frost, extreme heat, pests, disease, wildlife, irrigation systems, chemical applications, physical disturbance, and other conditions at the property.
You are responsible for providing ordinary watering and care after installation. Dandy's Care Guide provides general seasonal care information and recommendations. The Care Guide is included with the service, but its guidance does not create a warranty, guarantee, or promise of any particular plant lifespan, bloom duration, growth, appearance, or performance. Seasonal plants naturally grow, fade, flower, decline, or change appearance as the season progresses. Normal seasonal change is not a defect.
13. Changes to an Order
If you need to change an order, contact Dandy as soon as possible at hello@dandyporch.com. We will make reasonable efforts to accommodate requested changes, but changes are not guaranteed after plant material has been ordered, allocated, prepared, or installed. A requested change may affect price, plant availability, installation timing, or the design of the arrangement. No material change that increases your charge will be made without your approval.
14. Cancellation Before Installation
You may cancel an order by emailing hello@dandyporch.com.
More than seven days before your confirmed installation date or window: if we receive your cancellation more than seven calendar days before the beginning of your confirmed installation date or window, Dandy will refund the amount you paid for the cancelled services.
Seven days or less before installation: seasonal plants may be purchased or allocated specifically for your order. If you cancel seven calendar days or less before the beginning of your confirmed installation date or window, Dandy will refund the amount paid less any reasonable, nonrecoverable cost of plants or materials already purchased, allocated, or committed specifically for your order. We will not retain amounts for costs we did not actually incur or cannot reasonably attribute to your cancelled order.
After installation: once an arrangement has been installed, the service is complete and the order is not ordinarily refundable because of a change of mind or preference. Any rights available under applicable law continue to apply.
15. Cancellation or Rescheduling by Dandy
Dandy may postpone, reschedule, or cancel an installation when reasonably necessary because of severe or unsafe weather, plant shortages, supplier disruption, illness or staffing emergency, unsafe property conditions, inability to access the property, events beyond our reasonable control, or circumstances that would make installation inappropriate or likely to damage the plants or property.
If Dandy reschedules the service, you will not be charged an additional installation fee solely because of a delay caused by Dandy. If Dandy cancels an order and does not provide the purchased service, we will refund the amount paid for the cancelled portion of the order.
16. Weather and Seasonal Conditions
Weather is part of working with living plants outdoors. Dandy may determine that installation should be postponed when temperature, precipitation, storms, wind, frost, saturated soil, or other conditions make installation unsafe or horticulturally inappropriate. Weather-related delays do not constitute a breach of these Terms when Dandy reasonably reschedules the work.
17. Removal of Existing Material
When removal is included in your purchased service, you authorize Dandy to remove and dispose of ordinary seasonal plant material, soil, roots, and related botanical material located within the planter. You should remove any item that you wish to keep before our arrival. Unless you specifically tell us otherwise before installation, ordinary existing seasonal plant material left in the container may be treated as material authorized for removal and disposal. Dandy will not intentionally remove the planter itself or unrelated decorative objects without authorization.
18. Care of Your Property
Dandy will use reasonable care while working at your property. Please tell us promptly if you believe Dandy caused damage to your planter or other property. We may ask for photographs or other reasonable information so that we can investigate the issue.
If Dandy determines that property damage was caused by our negligence, we will work with you in good faith to repair the damage, arrange an appropriate remedy, or otherwise resolve the claim. Normal soil residue, water, plant debris, minor movement required to access a container, and ordinary conditions inherent in outdoor planting work do not constitute property damage.
19. Customer Photographs
You may have the option to upload photographs of your containers or property. Unless expressly stated otherwise, photographs are optional. By submitting a photograph, you represent that you have the right to provide it to Dandy and that Dandy may use it as reasonably necessary to evaluate, design, administer, and fulfill your order.
This permission does not by itself give Dandy permission to use your photographs publicly in advertising, social media, portfolio materials, or other marketing. Any marketing use of customer-provided photographs will require separate permission where Dandy seeks such permission.
20. Photographs Taken by Dandy
By placing an order, you authorize Dandy and its planting partners, at their discretion, to photograph your planters, completed arrangements, and the immediate surrounding area at your property before, during, or after installation.
Dandy may use photographs it takes for fulfillment records, quality control, training, portfolio purposes, social media, advertising, and other marketing or promotional purposes. Dandy is not required to photograph every property or installation, and photography is not a service Dandy promises to provide.
Dandy will use reasonable care to avoid publishing personally identifying information. We will not intentionally publish your name, street address, house number, license plate, recognizable image of you or another person, or other information that directly identifies you or your residence without separate permission. Dandy may crop, obscure, or otherwise edit photographs to preserve privacy where appropriate.
Your authorization for this limited photography is part of your agreement with Dandy. Any use of photographs that intentionally identifies you or your residence will require separate permission.
21. Communications About Your Order
By placing an order, you agree that Dandy may send transactional communications reasonably related to your purchase, including payment confirmation, order confirmation, scheduling information, installation updates, questions needed to fulfill your order, care information, and service follow-up. These communications are part of providing the service you requested. Care information does not create a warranty or guarantee of plant performance.
If you save an unfinished plan and request a return link, Dandy may email or otherwise deliver that link to you. You are responsible for protecting private links associated with your plan or order.
22. Marketing Communications
Marketing communications are separate from communications required to administer an order. Where consent is required, Dandy will obtain that consent separately. You may unsubscribe from marketing email using the unsubscribe method included in the communication. Unsubscribing from marketing communications does not prevent Dandy from sending communications necessary to administer an active order.
23. Privacy
Dandy's collection and handling of personal information is also governed by our Privacy Policy. Our Privacy Policy should be read together with these Terms. Third-party services involved in checkout, payment, hosting, communications, or other functionality may also process information under their own terms and privacy policies.
24. Shopify and Other Third-Party Services
Dandy uses Shopify and may use other third-party service providers to operate portions of our website, checkout, payment processing, communications, or business systems. Those providers are independent third parties. Your use of functionality provided directly by a third party may also be subject to that provider's applicable terms or policies.
Dandy is responsible for the seasonal planter services Dandy sells to you. We are not responsible for an independent third-party platform outage or failure that is outside our reasonable control, although we will make reasonable efforts to help resolve issues affecting your Dandy order.
25. Website Content
The Dandy website, including its text, photographs, graphics, designs, logos, branding, layouts, software, and other content, is owned by or licensed to Dandy and is protected by applicable intellectual-property laws. You may use the website for your personal, noncommercial use in evaluating or purchasing Dandy services.
You may not, without Dandy's permission, reproduce substantial portions of the website; copy or commercially exploit Dandy designs or branding; attempt to gain unauthorized access to the website or related systems; interfere with the operation or security of the website; use automated tools in a manner that materially burdens or disrupts the website; or use the website for unlawful or fraudulent purposes.
26. Website Availability
We try to keep dandyporch.com accurate and available, but we do not guarantee uninterrupted access. The website may occasionally be unavailable because of maintenance, updates, third-party outages, technical problems, or circumstances beyond our control. An error on the website does not require Dandy to honor an obviously erroneous price or product configuration when a reasonable customer would recognize the error. If an error affects an order you have already placed, we will contact you before making a material change to the order.
27. No Professional Horticultural or Structural Advice
Dandy provides seasonal planter design and planting services. Unless expressly agreed otherwise, our services do not include structural engineering, architectural services, drainage engineering, landscape architecture, pest-control services, irrigation design, arborist services, environmental consulting, or evaluation of the structural capacity of a building, balcony, deck, porch, railing, pedestal, wall, or other support. You remain responsible for ensuring that the location where your planter sits is suitable for the planter and its contents.
28. Disclaimer Concerning Living Products
Except for the express commitments stated in these Terms and any warranties that cannot legally be excluded, Dandy does not guarantee any particular plant lifespan, growth rate, bloom duration, mature appearance, or performance. We do not guarantee that natural materials will be identical in color, size, shape, or appearance. This section does not limit Dandy's obligation to perform the purchased services with reasonable care.
29. Limitation on Certain Damages
To the fullest extent permitted by applicable law, neither Dandy nor the customer will be liable to the other for remote, speculative, special, incidental, or consequential damages arising from an order when those damages were not reasonably foreseeable from the nature of the transaction.
This limitation does not exclude responsibility for direct physical damage to property caused by Dandy's negligence, fraud, intentional misconduct, or any liability that applicable law does not permit to be limited or excluded. Nothing in these Terms eliminates any consumer right that cannot legally be waived.
30. Claims and Opportunity to Resolve Problems
If you believe there is a problem with your service, please contact us promptly at hello@dandyporch.com. Providing notice gives us an opportunity to inspect the issue and propose an appropriate remedy. Nothing in this section prevents either party from exercising rights available under applicable law.
31. Governing Law
These Terms and any dispute arising from a Dandy order are governed by the laws of the State of Tennessee, without regard to principles of conflicts of law that would require application of another jurisdiction's substantive law.
32. Venue
To the extent permitted by applicable law, any court proceeding arising from these Terms or a Dandy order shall be brought in a court of competent jurisdiction located in Williamson County, Tennessee. Nothing in this section prevents a consumer from asserting a right to bring a claim in another forum when applicable law gives the consumer a nonwaivable right to do so.
33. No Mandatory Arbitration
These Terms do not require mandatory private arbitration. Either party may pursue a dispute in a court of competent jurisdiction, subject to applicable law and the venue provision above. The parties remain free to agree voluntarily to mediation or another method of dispute resolution after a dispute arises.
34. Force Majeure
Dandy is not responsible for a delay or failure to perform caused by circumstances outside our reasonable control, including severe weather, natural disaster, fire, governmental action, transportation disruption, widespread supplier failure, utility outage, labor disruption, epidemic, or similar event. This provision does not permit Dandy to retain payment indefinitely for services we ultimately do not provide. If performance becomes impracticable and the service is cancelled rather than rescheduled, Dandy will refund the amount paid for the unperformed portion of the order.
35. Assignment
You may not transfer an active Dandy order to another property or person without our consent. Dandy may use employees, independent contractors, planting partners, suppliers, and service providers in performing its obligations. Dandy may assign these Terms in connection with a bona fide merger, acquisition, reorganization, or transfer of substantially all of the business associated with Dandy, subject to applicable law. These Terms do not create a lien, encumbrance, security interest, or covenant running with your real property.
36. Entire Agreement
For a particular order, the agreement between you and Dandy consists of these Terms; the applicable order confirmation; the prices and selections accepted at checkout; any incorporated policy expressly identified as part of the order; and any written modification subsequently agreed to by both you and Dandy. These documents constitute the entire agreement relating to that order and supersede prior discussions concerning the same purchase. Nothing in this section permits Dandy to disclaim an express representation that applicable law makes binding.
37. Severability
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. The unenforceable provision will be interpreted or limited only to the extent necessary to make it enforceable when applicable law permits.
38. No Waiver
If Dandy or a customer does not immediately enforce a provision of these Terms, that does not permanently waive the right to enforce it later. A waiver concerning one event does not automatically waive rights concerning another event.
39. Headings
Section headings are provided for convenience and do not change the meaning of these Terms.
40. Changes to These Terms
Dandy may revise these Terms from time to time. The Terms that apply to a particular order are the version presented or made available when that order was placed, unless the parties later agree to a lawful modification. A later website update will not retroactively change the material terms of an already accepted order.
41. Electronic Agreement
You agree that this transaction may be conducted electronically. Placing an order, completing checkout, or otherwise taking an electronic action that the checkout process clearly identifies as acceptance may constitute your electronic agreement to these Terms. You may save or print a copy of these Terms for your records. Dandy may also retain an electronic record identifying the version of the Terms associated with your order.
42. Contact Us
Questions about an order or these Terms may be sent to Dandy Porch Club, Franklin, Tennessee, hello@dandyporch.com.
